Fisheries and Aquaculture Energy Efficiency Innovation Fund (FAEEIF) Terms and Conditions

• I am completing, signing and submitting the FAEEIF program application as a duly authorized representative of the applicant business and confirm that I have the authority to hereby bind the business.

• The information submitted as part of this application is accurate in all respects.

• I agree to maintain ownership of the asset(s), the acquisition of which was financed through FAEEIF funding, for a 24-month control period starting on the project completion date. If I do not retain ownership of a FAEEIF-funded asset for the entirety of the control period, I agree to repay all funds advanced from the FAEEIF to acquire the asset.

• I understand and agree to all terms and conditions as set out in the program guidelines.

• Efficiency Nova Scotia is a franchise operated by EfficiencyOne, the official Licensee of the Province of Nova Scotia. I understand that in the event my application is successful, and FAEEIF funding is granted to the business, the business will be required to enter into a funding agreement with EfficiencyOne. That agreement will be subject to and governed by the laws of Nova Scotia and shall not be assigned by the business, in whole or in part, without the written consent of EfficiencyOne.

• By completing, signing and submitting the FAEEIF program application, I agree to release the business’s application information to the current and successive holders of the Efficiency Nova Scotia franchise.

• By completing, signing, and submitting the FAEEIF program application, I hereby consent to the purposes for which Efficiency Nova Scotia is collecting, using, and disclosing applicant business information, as set out in Efficiency Nova Scotia’s Privacy Policy. More information on Efficiency Nova Scotia’s Privacy Policy can be found online at efficiencyns.ca/privacy-policy or by email request at privacy@efficiencyns.ca.

• Only costs related to measures described in the program guidelines are eligible for incentives. Efficiency Nova Scotia has complete discretion to determine whether a specific cost comes within the scope of the program guidelines.

• Harmonized Sales Tax (“HST”) is considered to be an eligible cost, unless a business is exempt from payment of HST, or a business is eligible for a refund of the HST paid.

• By signing a completed FAEEIF application, you agree to the terms and conditions and confirm the application information provided is complete and accurate. If you sign a completed application and you have not read the terms, then you are still deemed to have agreed to be bound by them.

• I consent to the use and disclosure of the application information by officials of the Nova Scotia Department of Fisheries, officials of programs offered by the Government of Canada or the Province of Nova Scotia, and cooperating funding partners, where the information is relevant for the purposes of audit, analysis, evaluation, program development and determining program funding.

• I consent to the audit and verification of the application information at any time prior to project commencement, during project work, or upon completion of the project. Such audit and verification may be performed by Efficiency Nova Scotia, the Province of Nova Scotia, the Government of Canada, or other parties chosen by the Nova Scotia Department of Fisheries for audit and verification purposes.

• I have declared all related project funding from other programs, including program name and amount. In the event that I receive FAEEIF funding that is determined through audit or inspection to duplicate related funding that has been received from other sources, I agree to repay the amount of that duplicate FAEEIF funding that I receive.

• I consent to the release of my business name and the amount of any FAEEIF funding received as public information, to be actively disseminated by the Province of Nova Scotia and the Government of Canada.

• I acknowledge that application information, to any extent not dealt with in these terms and conditions, will be subject to the provisions of the Freedom of Information and Protection of Privacy Act (FOIPOP).

• I consent to representatives of the Nova Scotia Department of Fisheries contacting me to discuss the results of the program.

• I consent to the Nova Scotia Department of Fisheries publishing the results of the program with respect to the project which may include my name, my business location, the amount received, and details about the projects associated with this program.

If application is selected for funding, I agree:

• To make no public disclosure of my FAEEIF funding before the Nova Scotia Department of Fisheries and Aquaculture (NSDFA) or Efficiency Nova Scotia has publicly announced all successful applicants following a call for proposals.

• To provide NSDFA with forty-eight (48) hours’ advance notice of any public disclosure that I propose to make concerning my FAEEIF funding.

• As part of the forty-eight (48) hours’ advance notice, to provide NSDFA, for its review and opportunity to provide input, the text of any written public announcement that I propose to make concerning my funding award.

• To acknowledge, as part of any public disclosure I make involving my applicant’s funding, the contribution of the FAEEIF funding agencies.
